Penegakan Hukum Terhadap Masyarakat Dalam Menghadapi Deforestasi Hutan Adat Papua

Abstract

Law enforcement against deforestation in Papua's customary forests is a complex issue, involving environmental protection and recognition of indigenous peoples' rights. Deforestation activities in these areas are often caused by exploitation by irresponsible companies and individuals. Such practices not only threaten the sustainability of the ecosystem, but also violate the rights of indigenous peoples who have historical and spiritual connections to the forest. This research aims to examine the effectiveness of law enforcement against deforestation of customary forests in the Papua region, focusing on government efforts, the role of customary institutions, and the application of relevant regulations. Using the Normative Juridical method, this research analyzes statutory regulations as well as the impact of deforestation on the lives of indigenous peoples. The research findings reveal that the law enforcement process faces various challenges, such as weak supervision, conflicts of interest, and the lack of involvement of indigenous peoples in the decision-making process. The results of this study highlight the need for a more comprehensive approach, involving cooperation between the government, customary institutions and civil society to strengthen law enforcement and preserve customary forests sustainably. The protection of Papua's customary forests is not only important for the survival of indigenous peoples, but also for the preservation of the environment as a whole. Therefore, inclusive and sustainability-oriented policies are needed, actively involving indigenous peoples at every stage of the planning and decision-making process concerning customary forests.
