Reconciliation of Traditional Territories of Indiginious Communities from the Perspective of Collaborative Governance

Abstract


The village is the smallest and lowest governmental unit in the Unitary State of the Republic of Indonesia. With the establishment of the Indonesian state and the enactment of regulations related to state-formed villages with Western characteristics, a confrontation is inevitable between indigenous model villages and Western model villages, which have different values. This study aims to analyze and explain the customary areas of indigenous communities in Boti Village and how reconciliation is approached from the perspective of collaborative governance. The study uses a qualitative approach with a case study research design. The research is located in Boti Village, East Nusa Tenggara Province. Informants were selected using purposive sampling techniques. The focus of the study is on the reconciliation of the customary areas in the Boti community from the perspective of collaborative governance. Data analysis follows the approach outlined by Creswell. The study’s findings suggest that, from the perspective of collaborative governance, the management of the Boti community's customary territory should adopt the Boti Village Territory Reconciliation Model. This model uses the King Model as the coordinator of the Traditional Village Territory, where other villages are also designated as traditional villages, or it adopts the Boti Village Territory Reconciliation Model of Traditional Village Exclusivity, where Boti Traditional Village becomes an Exclusive Traditional Area Village, with customary authority extending to other villages within the Boti customary and genealogical territory.
