Substansi Gagasan dalam Beberapa Konsep Negara Hukum

Abstract


The diversity of conceptions of the rule of law raises whether or not they contain the same idea? This juridical-normative research finds that the diversity of conceptions of the rule of law is strongly influenced by the historical and conceptual specificities of the underlying national traditions. The idea of the rule of law has marked the entire historical span of an idea (historical span of a notion) that cannot be separated from the national culture in which the idea is located and is actually used. The concept of the rule of law boils down to protecting the rights and freedoms of individuals (dignity of man) and restricting the state to respect individual rights without discrimination. Thus there must be a division of power and an independent judiciary to supervise and guarantee adherence to the law.

Keragaman konsepsi negara hukum menimbulkan pertanyaan apakah mengandung gagasan yang sama ataukah tidak? Penelitian yuridis-normatif ini menemukan fakta bahwa keragaman konsepsi negara hukum disebabkan oleh sangat dipengaruhi oleh kekhususan historis dan koseptual dari tradisi nasional yang mendasarinya. Gagasan negara hukum telah menandai keseluruhan rentang sejarah sebuah gagasan (historical span of a notion) yang tidak dapat dipisahkan dari budaya nasional (national culture) dimana gagasan tersebut berada dan benar-benar dipergunakan (actually used). Konsepsi negara hukum sebenarnya bermuara pada perlindungan hak dan kebebasan individu (dignity of man) dan pembatasan negara untuk menghormati hak-hak individu tanpa diskriminasi. Dengan demikian harus ada pembagian kekuasaan dan Lembaga peradilan yang independent untuk mengawasi dan jaminan ditaatinya hokum.
