Hukum Humaniter Internasional: Perlindungan Terhadap Anak-Anak yang Menjadi Korban pada Konflik Bersenjata Internasional

Abstract


Armed conflict is an activity that has an impact on humanity such as indiscriminate killings, destruction of public and private facilities and infrastructure, confiscation of property, and so on. The most vulnerable party affected by conditions of war or armed conflict is civil society. Therefore, in armed conflict there must be rules to protect the rights of the civilian population so that they do not become victims in war or armed conflict. The first problem is how to regulate the protection of children who are victims of international armed conflicts in the 1949 Geneva Convention? And secondly, is the protection of children in the international armed conflict Russia and Ukraine in accordance with the 1949 Geneva Convention? The theory used in this study is the theory of legal protection and humanitarian principles. The method used is normative juridical research method by examining literature or secondary data. The data collection technique was carried out by means of a literature study and the analysis used in this writing uses qualitative analysis by describing the subject or object of the research. The results of this study are, firstly, the protection of children in international armed conflicts has been clearly regulated in the 1949 Geneva Conventions, Additional Protocols I and II, and in several other international provisions. Under any circumstances civilians must receive legal protection and are not allowed to treat civilians with inhumane treatment and torture in any form. Second, the protection of children who are victims of international armed conflicts is not in accordance with the 1949 Geneva Convention. Because Russia recruits children who have not reached the age of 18 years to become soldiers of war.
